Garrett C. Donley

Mr. Donley's practice includes international patent and trademark prosecution and enforcement, including related litigation. His patent prosecution work is directed to the medical appliances, materials and various mechanical fields. He performs patentability searches, prepares, files and amends U.S. and PCT international patent applications and negotiates directly with patent examiners for securing allowances and directing foreign national prosecution. His experience in international trademark prosecution includes conducting clearance searches, preparing, filing and amending U.S. trademark applications, negotiating applications with trademark examining attorneys, directing foreign trademark prosecution, recording trademark ownership changes internationally and trademark portfolio planning and management.

Mr. Donley’s enforcement and litigation experience includes preparing and filing suits in the federal courts, conducting discovery, researching legal and technical issues, negotiating settlements and trial activities. He also routinely investigates patent and trademark infringements, prepares enforcement notifications and oppositions and negotiates subsequent enforcement arrangements, evaluates the legal scope of patents and other publications for patentability, validity, freedom-to-practice and infringement determinations and prepares legal opinions on these issues.
