St. Louis patent litigator Matt Cutler recently spoke to Law360 about some of the most significant patent disputes over the past decade. Many of these cases had a profound impact on patent law at the time, and many continue to shape patent law today.
Speaking about Octane Fitness v. Icon Health & Fitness, for which he served as lead counsel in the district court case, Cutler shared the following insights:
By making it easier to obtain attorney fees for inappropriate litigation practices, the decision recalibrated the types of cases being brought in the first place. Patent trolls are thinking twice about the specious cases they’d bring in the early 2010s and really move forward with large settlement demands in only the strongest of cases.
